TERMS OF USE

Effective Date: September 9, 2026
Last Updated: September 9, 2026

These Terms of Use (“Terms”) govern your access to and use of the website operated by Stopa & Associates, LLC (“Stopa & Associates,” “Firm,” “we,” “us,” or “our”), including the content, features, communications, and services available through the website (collectively, the “Website”).

These Terms also include the terms applicable to SMS/text messages sent by Stopa & Associates.

Please read these Terms carefully. By accessing or using the Website, you acknowledge that you have read and agree to these Terms. If you do not agree with these Terms, please do not use the Website.

1. Informational Purposes Only — No Legal Advice

The materials and information provided on this Website are for general informational purposes only.

Nothing on this Website constitutes legal advice.

The information provided on the Website may not reflect the most current legal developments and may not apply to your particular circumstances. Laws, regulations, court decisions, and legal standards change over time and may vary depending on the applicable jurisdiction and specific facts.

You should not act, or refrain from acting, based on information contained on this Website without obtaining advice from a qualified attorney regarding your particular circumstances.

2. No Attorney-Client Relationship

Your access to or use of this Website does not create an attorney-client relationship between you and Stopa & Associates.

Similarly, submitting a contact form, sending an email or text message, calling the Firm, or otherwise contacting us does not, by itself, create an attorney-client relationship.

An attorney-client relationship is established only after Stopa & Associates has determined that it is able and willing to accept the engagement, including completion of any appropriate conflict review, and the Firm and prospective client have entered into an appropriate engagement arrangement.

You should not rely on the submission of a Website inquiry, email, or text message as confirmation that the Firm has agreed to represent you.

Unless and until an attorney-client relationship has been established, you remain responsible for protecting your legal rights, complying with applicable deadlines, and obtaining legal representation where appropriate.

3. Confidential and Sensitive Information

Please do not send confidential, highly sensitive, or time-sensitive information through the Website or by unsolicited text message unless specifically requested by an attorney at Stopa & Associates.

Information submitted through a contact form or other Website feature may be transmitted through and stored on systems operated by third-party technology providers, including our website hosting provider.

Submitting information through the Website or by text message does not, by itself, guarantee that the information will be protected by the attorney-client privilege.

If you are already a client of Stopa & Associates, the Firm's professional obligations concerning client confidentiality and attorney-client privilege apply independently of these Terms.

Nothing in these Terms is intended to waive, limit, or modify any duty of confidentiality imposed on Stopa & Associates by applicable law, the Massachusetts Rules of Professional Conduct, or an established attorney-client relationship.

  • use the Website to transmit unlawful, fraudulent, threatening, defamatory, or otherwise harmful material; or
  • use Website content in a manner that infringes our intellectual property rights or the rights of another person.

We reserve the right to restrict or terminate access to the Website where we reasonably believe these Terms have been violated.

9. Intellectual Property

Unless otherwise indicated, the Website and its contents—including text, graphics, logos, photographs, designs, page layouts, and other original materials—are owned by or licensed to Stopa & Associates and are protected by applicable intellectual property laws.

You may view, download, or print reasonable portions of Website content for your personal, noncommercial, informational use.

Except as permitted by applicable law, you may not reproduce, republish, distribute, modify, display, sell, license, or commercially exploit Website content without our prior written permission.

We do not guarantee that the Website will always be available, uninterrupted, error-free, or secure.

We may suspend, modify, restrict, or discontinue all or any portion of the Website at any time, including for maintenance, security, technical, legal, or business reasons.

Although we take reasonable measures designed to protect the Website and information transmitted through it, Internet and electronic communications cannot be guaranteed to be completely secure.

13. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

STOPA & ASSOCIATES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, CONCERNING THE WEBSITE OR ITS CONTENT, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED.

WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, FREE OF HARMFUL COMPONENTS, OR THAT INFORMATION ON THE WEBSITE WILL BE COMPLETE, ACCURATE, OR CURRENT.

Nothing in these Terms limits or excludes liability to the extent such liability cannot lawfully be limited or excluded.

Nothing in this section limits any professional obligation or liability arising from an attorney-client relationship that is governed by separate applicable law and professional standards.

15. Privacy Policy

Our collection, use, disclosure, and protection of information through the Website and our SMS communications are described in the Stopa & Associates, LLC Privacy Policy.

The Privacy Policy is incorporated into these Terms by reference.

16. No Reliance on Electronic Communications for Deadlines

You should not use the Website, a Website contact form, unsolicited email, or text messaging to communicate information concerning an imminent court date, filing deadline, statute of limitations, emergency, or other time-sensitive matter.

A Website submission, email, or text message should not be considered received or accepted by Stopa & Associates until the Firm has affirmatively acknowledged the communication.

The Firm is not responsible for protecting a legal deadline or taking action on your behalf unless an attorney-client relationship has been established and the Firm has agreed to undertake the relevant responsibility.

17. Geographic Scope

Stopa & Associates is a Massachusetts law firm. The Website is intended primarily to provide information concerning the Firm and its services.

The availability of information through the Website should not be understood as a representation that the Firm's attorneys are authorized to practice law in every jurisdiction from which the Website may be accessed.

Professional services are provided only where permitted by applicable law and rules governing the practice of law.

18. Governing Law

These Terms and your use of the Website are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-laws principles, except to the extent otherwise required by applicable law.

Any dispute arising solely from the use of this Website and these Terms shall be subject to the jurisdiction of the state and federal courts having jurisdiction in Massachusetts, to the extent permitted by applicable law.

This provision does not alter any governing-law, forum, arbitration, or dispute-resolution provision contained in a separate engagement agreement between Stopa & Associates and a client.

19. Changes to These Terms

We may modify these Terms periodically to reflect changes to the Website, our SMS messaging program, our practices, applicable law, or other circumstances.

Changes become effective when the revised Terms are posted to the Website unless otherwise stated.

The “Last Updated” date at the top of these Terms identifies when they were most recently revised.

20. Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law or, where appropriate, severed from these Terms. The remaining provisions will remain in effect.

21. Entire Agreement Regarding Website Use

These Terms, together with the Privacy Policy and any other policies expressly incorporated by reference, constitute the agreement between you and Stopa & Associates concerning your use of the Website.

These Terms do not supersede or modify an engagement letter, fee agreement, or other agreement between Stopa & Associates and an existing client.

If there is a conflict between these Terms and an applicable client engagement agreement concerning legal services, the engagement agreement controls with respect to those legal services.
